1. Service Operator

CinePhone is operated by Smoothware Solutions, LLC. In these Terms, "CinePhone," "we," "us," and "our" refer to Smoothware Solutions, LLC.

2. Acceptance of Terms

By accessing or using CinePhone ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

3. Description of Service

CinePhone is a web-based video editing tool that allows you to add device frames, cinematic zoom effects, and beautiful backgrounds to your screen recordings. The video processing occurs entirely in your browser.

CinePhone is a direct software service. We are not a marketplace and do not facilitate peer-to-peer payments, creator payouts, or third-party payment processing between users.

4. User Accounts

To access certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information to keep it accurate and current.

5. Billing, Cancellation, and Refunds

CinePhone offers free access and paid plans, including recurring subscriptions (monthly/yearly) and one-time lifetime access. Paid subscriptions renew automatically unless canceled before the next billing date.

You may cancel your subscription at any time through Stripe Billing Portal. Cancellation takes effect at the end of your current billing period. Unless required by law, we do not provide prorated refunds for partial subscription periods.

Lifetime purchases are one-time, non-recurring charges. Unless required by law or explicitly stated in a promotion, lifetime purchases are non-refundable.

6. Fulfillment and Delivery

CinePhone is a digital service. Access is fulfilled electronically after successful payment and account verification. We do not ship physical goods.

7. Acceptable Use

You agree to use the Service only for lawful purposes. You may not use the Service to:

• Create or distribute content that is illegal, harmful, or infringes on others' rights
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its servers
• Resell or redistribute the Service without authorization

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by CinePhone and is protected by international copyright, trademark, and other intellectual property laws.

You retain full ownership of any videos you create using the Service. We claim no rights to your content.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, CinePhone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of the Service.

11. Promotions and Discounts

Promotional offers may be subject to eligibility rules, availability limits, expiration dates, and separate terms. Offers may not be combinable unless explicitly stated.
